Introduction to Taiwan Entrepreneur Visa

This introduction is suitable for who are interested in starting a business in Taiwan(excluding Chinese mainland). The advantages of Entrepreneur visa include: no need to set up a business beforehand, 2 years residency, extension without leaving Taiwan, availability of group application and the applicants are eligible to apply for Youth Business Start-up Loan.

The applicant's foreign spouse, children under the age of 18, and children over the age of 18 who are unable to take care of themselves due to physical or mental disabilities may apply for dependent residence together.

  1. Qualifications

    Entrepreneur visa can be applied for as an individual or as a team, each of which must meet one of the following conditions:

    Individual Application

    (1)
    Has secured investment from Taiwan or overseas venture capital, secured investment from the Executive Yuan Startup Angel Project, or obtained funding of at least NTD2 million in investment (fund-raising) from a Taiwan approved international startup fund-raising platform.

    (2)
    Has physically stationed in within one year, or is physically stationing in the following startup parks or startup incubators, and has been recommended by such parks or incubators:
    a. International start-up parks and projects approved by Taiwan
    b. The Taiwan operated startup incubators, or those registered in the MOEA (Ministry of Economic Affairs) and approved and announced by the MOEA.
    c. Foreign startup incubators recognized by Taiwan.

    (3)
    Has been awarded an invention patent in a foreign country or an invention/design patent in Taiwan, or can demonstrated other evidence of professional expertise.

    (4)
    Has obtained plant variety rights, or animal name registration in Taiwan, but does not include those implemented by rights assignment or authorization.

    (5)
    Has won an award in a leading Taiwan/international business start-up or design competition, or received approval of the project of encouraging overseas entrepreneurs to invest in Taiwan.

    (6)
    Has been shortlisted or awarded in indicative Taiwan/international fashion shows, film festivals, or style awards.

    (7)
    Possesses such other innovation capability as may be specified or recommended by the authority.

    (8)
    Has established an enterprise that complies with the Directions of Recognition for Startups with Innovation Capability with at least NT$ 1 million investment in Taiwan and has been serving as the legal representative, manager or director of that enterprise.

    Group (Team) Application

    (1)
    The applicant who has not established an enterprise in Taiwan shall meet at least one of the above criteria except for the item (8).

    (2)
    For the applicant who has already established an enterprise in Taiwan that complies with the Directions of Recognition for Startups with Innovation Capability, the members of the team or group shall be serving as legal representative, executive officers or managers of the enterprise, and the members shall have invested a combined total of at least NT$1 million in such enterprise.

    (3)
    The size of a group (team) shall be less than 3 people.

  2. Required Documents and Materials

    (1)
    A passport with a remaining validity of at least 6 months and one recent 2-inch passport photo taken within the past 6 months

    (2)
    Documentary proof of meeting the qualification requirements specified in "the Principles for Reviewing Foreigners' Qualifications for an Entrepreneur Visa and ARC in Taiwan". In the case of team applications, an Entrepreneur Team Intent Letter should be additionally submitted.

    (3)
    Hong Kong/Macao Applicants must also provide the following documents:
    a. Proof of permanent residency from Hong Kong or Macau (passport with more than 3 months validity or permanent resident identity card)
    b. A signed guarantee letter along with guarantor’s Taiwanese ID card; if the guarantor is not a relative within second degree of kinship or a spouse, proof of the guarantor’s employment certificate must be submitted
    c. A Certificates of No Criminal Conviction (CNCC) from Hong Kong or Macau with the record of past 5 years (issued within 3 months)
    d. A health examination certificate (issued within 3 months)
    e. For those who applying during their stay in Taiwan, the current Entry & Exit Permit must also be submitted (it must be returned when the ARC is issued)
    f. A signed Identity Verification Form from Hong Kong or Macau residents
    g. A residency application form for Hong Kong or Macau residents.

    When the applicant's business enterprise in Taiwan meets at least one of the criteria listed below, the applicant may apply for an extension within 4 months before the expiry date of his/her ARC and submit the qualification review documents:

    (1)
    The sales revenue of the applicant's enterprise for the most recent year, or the average for the most recent three years, is at least NT$3 million.

    (2)
    The operating expenses of the applicant's enterprise for the most recent year, or the average for the most recent three years, is at least NT$1 million.

    (3)
    The applicant's enterprise employs at least three full-time Taiwanese nationality employees.

    (4)
    The applicant's enterprise can demonstrate some other category of operational performance that leads the industry competent authority to determine that the enterprise is making a positive contribution to Taiwan's economic development.

  3. Estimated Time Frame

    With all the correct documentation submitted, it can take around 60 working days to complete the entire Taiwan application process. However, the actual timeline may vary depending on the specifics of each case.

  4. Validity Period

    The initial residence period is 2 years. If the conditions for an extension are met, the applicant may apply for an extension, with each extension not exceeding 2 years. Before the ARC's expiration, if the applicant meets the relevant qualifications, they may also apply for a Taiwan Employment Gold Card.

    Foreigners who hold this ARC card and have continuously resided in Taiwan for 5 years, staying in Taiwan for more than 183 days per year, may apply for permanent residency. Hong Kong and Macau residents who hold this certificate and have continuously resided in Taiwan for 5 years, staying in Taiwan for more than 183 days per year, may apply for settlement. After obtaining the settlement permit, they must register for naturalization at the Household Registration Office within 30 days to acquire a Taiwanese ID.

  5. Important Note

    The list above is not the final list of information and documents, the Taiwan National Immigration Agency could request for additional documents for review. If the foreigner holds the specific nationality announced by the Taiwan immigration, pertinent documents should first be examined by the Representative Office of Taiwan. Client should provide the original verified documents to Kaizen.
