EU vs. UAE: Examining the Efficiency of Multi-Jurisdiction Trademark Applications

While both EU and UAE trademark applications offer wide regional coverage, their official examination processes couldn't be more different.

The European Union Intellectual Property Office (EUIPO) prioritizes speed. To save time, they completely skip checking for “relative grounds” (prior conflicting trademarks), leaving that responsibility entirely to the market through opposition process. The UAE, on the other hand, takes the exact opposite approach. Their registry handles both absolute and relative grounds simultaneously, yet somehow, they still manage to keep approval times remarkably fast.

This stark contrast ultimately comes down to fundamental differences in legal frameworks, language complexities, and how each registry defines its own role.

  1. “Unitary Effect” vs. “Independent Registration”

Operate under the “principle of unitary effect”.

A single application covers all 27 member states.

Operate on the “principle of independent registration”.

No such thing as a single registration covering all six countries.

Comprehensive searches across 28 different databases (the 27 individual countries plus the EU registry).

Comprehensive searches limiting the scope to the seven emirates

If the registry were to proactively search for conflicts, the EUIPO would have to cross-reference 27 separate national databases at the same time. In contrast, the UAE examiners only need to search their own national database. This significantly keeps the process moving fast.

  2. The Language Barrier in Multi-Jurisdiction Searches

The EU operates with 24 official languages.

Its business and regulatory environments run entirely on a dual Arabic and English system.

Needs to evaluate whether a trademark's text or design clashes phonetically, visually, or conceptually with existing local trademarks across entirely different linguistic contexts.

Don't have to deal with any cross-border or cross-linguistic communication barriers.

In practice, it is difficult for the EUIPO to conduct cross-lingual comparisons across 24 official languages.

  3. “Market Self-Regulation” vs. “Official Filtering”

Prior trademark owners are in the best position to know whether a new trademark will cause confusion.

By pairing digital systems with manual reviews, examiners directly eliminate any conflicting or similar applications right at the examination stage.

The companies might use completely different sales channels, or they might have already signed a coexistence agreement.

If EUIPO stepped in and rejected applications proactively, it would interfere with business freedom.

The authorities prefer to thoroughly clear potential conflicts before any trademark gets approved.

  4. Application Volume, Official Fees and Resource Allocation

    EU Trademark

EUIPO processes hundreds of thousands of applications every year.

Total application volume is much lower than the EUIPO.

The official fee for filing one mark in one class is €850.

Official fee for registering a trademark in the UAE is nearly twice as high as the EUs.

They do offer a Fast Track option, it is strictly limited to applications that use pre-approved standard terms and cannot pay extra to speed up the process.

Offers a paid Express Examination option for one-day processing.

With such a massive workload, forcing the registry to handle cross-border relative grounds checks would completely overwhelm the administrative system. In the other hand, the UAE authorities have plenty of funding to allocate the necessary staff and technology to pull off a comprehensive absolute and relative grounds review in a single day.

Conclusion

The EU trademark registry's apparent lack of efficiency when checking for conflicts comes down to a clear logistical challenge. It has to navigate 27 national databases and 24 official languages simultaneously. By contrast, the UAE's high efficiency stems from a highly centralized, single-country examination model.

Because of this, businesses need to adapt their strategies when establishing a global brand. For the EU market, the focus should be on post-filing monitoring and the opposition process. In the UAE, conducting a thorough trademark search before you file is absolutely essential.
