Q&A on Foreigner’s Work Permit in China

  1. Q: Is there a classification for foreigners working in China?

A: Foreigners working in China are divided into three categories for management, i.e. high-end talents (Category A), foreign professionals (Category B) and other foreigners (Category C).

  2. Q: Is there an age limit for foreigners working in China?

A: According to the relevant regulations of the PRC, foreigners applying for a work permit in China must be at least 18 years old. There is no maximum age limit for foreign high-end talents applying for Category A work permits. The maximum age limit for foreign professionals applying for Category B work permits and other foreigners applying for Category C work permits is generally not more than 60 years old.

  3. Q: How many days in advance is required to apply for an extension of a foreigner's work permit?

A: According to the relevant regulations, the application for extension of a foreigner's work permit must be submitted to the approving authority at least 30 days before the expiration of the work permit. Late submission will result in the rejection of extension.

  4. Q: Is it possible to apply for a longer validity period when applying for an extension of a Category B work permit?

A: A foreign professional holding a Category B work permit, who has applied for two consecutive work permits, including one new application and one extension, without changing the employer, may apply for a work permit valid for two years based on the contract term when applying for an extension again.

  5. Q: Does a foreigner holding a PRC foreign permanent resident ID card need to apply for a work permit in China?

    A: No need.

  6. Q: Has China cancelled the issuance of physical foreigner’s work permit?

A: Yes. Starting from 1 December 2024, China has cancelled the issuance of physical foreigner’s work permits and implemented a policy of integration of foreigner’s work permit and social security card instead. Foreigner’s work permit information will be directly loaded into their electronic or physical social security card.
