A: An auctioneer refers to an enterprise legal person established in accordance with the Auction Law and the Company Law to engage in auction activities.

Q: How can enterprises obtain the license for auction business?
A: An enterprise must obtain the license to engage in auction business after being examined and approved by the department in charge of the auction industry of the provincial, autonomous regional or municipal people's government where it is located.

Q: What conditions must an enterprise meet to apply for an auction business license?
A: When an enterprise applies for a license to engage in auction business, it shall meet the following conditions:
  1. Have a registered capital of more than one million RMB;
  2. It has its own name, organizational structure, domicile and articles of association;
  3. There are auctioneers and other staff members commensurate with the auction business.
  4. There are auction business rules that comply with relevant laws and regulations;
  5. Comply with the relevant regulations of The State Council on the development of the auction industry;
  6. Other conditions as prescribed by laws and administrative regulations.

Q: What additional conditions must an enterprise meet to operate cultural relics auctions?
A: An auction enterprise engaged in the auction of cultural relics shall have a registered capital of more than 10 million yuan and personnel with professional knowledge of cultural relics auctions.
