China Releases New Version of Market Access Negative List

On 24 April 2025, the National Development and Reform Commission, the Ministry of Commerce, and the State Administration for Market Regulation officially released the "Market Access Negative List (2025 Edition)". This is the fourth revision since the first version of the list was released in 2018 in China. The new version of the list has reduced the number of items from 117 in the 2022 version to 106 and compared to the first version of the list in 2018, the reduction in listed items has reached 30%.

Market access is the starting point for all types of business entities to conduct business and participate in competition. The most core requirement of the negative list management model is "entry is allowed if not prohibited", that is, in the fields outside the negative list for market access, whether it is state-owned enterprises or private enterprises, domestic or foreign capital, large enterprises or small and medium-sized enterprises, all types of business entities can enter on an equal footing in accordance with the law. As the number of items on the negative list decreases, restrictions on the entry of a large number of industries have been relaxed, which is a huge benefit for all kinds of business entities.

The main changes in the " Market Access Negative List (2025 Edition)" include:

Reduce national management measures: Eight national access restrictions have been deleted. For instance, the seal engraving industry has been shifted from a licensing system to a filing one, and the sales business of computer information system security-specific products has been changed to a testing and certification system based on mandatory national standards.

Partial relaxation of national measures: Management measures such as the establishment of TV drama production units, the preparation for the establishment of drug wholesale and retail enterprises, Internet information services for drugs and medical devices, the import of forest tree seeds, and the printing of value-added tax invoices have been abolished. Necessary market access management is maintained in relevant fields, but the access procedures have been further streamlined.

Reduce local administrative measures: 17 local measures have been deleted, covering areas such as transportation and logistics, freight forwarding, and vehicle rental services. The corresponding local licensing measures have been abolished, and a unified national access method has been implemented.
