Foreign investors can set up wholly foreign owned human resources service companies in China according to the PRC Interim Provisions on the Management of Foreign Invested Job Intermediary Agencies and Interim Provision on the Establishment and Administration of Foreign Invested Job Referral Agencies.

Is it necessary for foreign investors to have more than three years of relevant experience when they apply for the incorporation of a wholly foreign owned HR service company in China?
A:
The requirement of more than three years of relevant experience in human resources has been abolished in accordance with the PRC Interim Provisions on the Management of Foreign Invested Job Intermediary Agencies and Interim Provision on the Establishment and Administration of Foreign Invested Job Referral Agencies.

Am I required to apply for a license for providing human resources service?
A:
According to the PRC Interim Regulation on Human Resources Market, a human resources service license is required if you will engage in the following job intermediary activities: recommend employers to job seekers, recommend job candidates to employers, provide employment information to employers and individuals, engaged in internet human resources information services, organize on-site job fairs, carry out online recruitment, carry out senior talent search service and so on.

What kind of services do not require a human resources service license?
A:
According to the PRC Interim Regulation on Human Resources Market, human resources service companies engaging in the collection and release of information concerning the availability and needs for human resources, employment and start-up guidance, human resource management consultation, human resources evaluation, human resources training, human resources service outsourcing and other human resources services are only required to record with the competent authorities for human resources. The human resources service license is not required under such circumstances.

The term of validity of a human resources service license in China is five years.
