Canada Trademark Registration Costs and Registration Procedures |
Unless otherwise indicated, the Canada Trademark Registration stated in this quotation refers to trade-mark registrations in accordance with the Trademarks Act. All fees in this quotation are valid until 30 June 2025.
The legal basis of Canada's trademark is the Trademarks Act. Canada is a member of the Paris Conven-tion and the Madrid Union. Canada adopts first-to-file basis for trademark protection. Trademark regis-tration is valid for 10 years from the date of registration and could be renewed for 10 years before the expiry date.
Our fees for filing an application in Canada are USD1,090 (HKD8,611) for the first class and USD410 (HKD3,239) for each additional class. The fees cover 20 goods/services per class. Each 10 items (less than 10 items will be calculated as 10 items) in excess of 20 will be charged at USD10 (HKD79). The fee for obtaining a certificate is USD200 (HKD1,580) for each application.
For the purpose of registering a trademark in Canada, you will need to provide some basic information of the proprietor (individual or company), such as the full name, address, nationality. You are also re-quested to select the goods/services for each class.
A registration in Canada usually takes 16-26 months from the date of filing the application which in-cludes 2 months of Publication for the Opposition period.
If the application is being rejected by the Canadian Intellectual Property Office (CIPO) or opposed by any third party, Kaizen can help to response to the rejection or opposition and our fees will be quoted upon request.
CIPO will issue an electronic Certificate of Registration.

5. | Payment Term and Payment Method |
Upon receipt of your confirmation of engagement, we will issue and send an invoice together with the wiring instructions to you for your settlement. When you arrange the payment, please put our invoice number of account number in the message section and then send email a copy of the re-mittance receipt to us for our records. Because of the nature of service, we require full payment in advance. And once the service is commenced, no refund of service fee will be made.
We accept cash, HKD check, TT and credit card through Paypal. An extra handling fee of 5% will be charged if paid by Paypal. If a China or Taiwan Value-Added Tax invoice is required, 7.5% or 5% additional charge will be incurred.

6. | Refund Policy |
No refund of fees will be made after the commencement of services. For example, if we have conducted a pre-filing search and found an identical mark is already in the register, the application will not be proceeded, the fees for pre-filing search will not be refunded. If we have already filed an application and the application is objected by the CIPO or any other party or refused, there will not be any refunded of fees. In case you have paid our fees for all three stages of an application and the search result indicates that an identical mark is already in the register, the application will not be proceeded. The fees for services not performed, i.e., filing for application and issuing of certificate of registration will be refunded, after deducting bank wiring charge. |
