Q:
If an individual has already filed for income tax settlement declaration in accordance with the Income Tax Act, but has failed to declare the basic income amount, which caused an under-report of basic income tax amount, what is the penalty for it?
A: If the authority finds out an under-report of basic income tax amount and other income amount listed in the Income Basic Tax Act, in addition to determining the tax payable in accordance with this Act, impose a fine of no more than three times the amount of tax determined as payable.

Q:
The year in which Taiwanese individuals' overseas income is included in the basic income?
A:
1. Overseas income is obtained after January 1, 2010, shall be included in the basic income of the obtained year.
2. In the case of stock trading income, the year of the payment date refers to the year of the stock trading date; if it is the income from the fund beneficiary certificate transaction, it refers to the year of the date when the contract agrees to calculate the repurchase price.

What is the scope and item or type of overseas income of Taiwanese individuals?
A:
1. Overseas income refers to income from out of Taiwan stipulated in Article 8 of the Income Tax Act and the Mainland region stipulated in the Act Governing Relations between the People of the Taiwan Area and the Mainland Area.
2. To facilitate calculations, the items or categories of individual income from overseas are the same as those from the Republic of China, which are also divided into 10 categories, including overseas

salary income

interest income

Income from lease and royalties
6)
Income from self-employed farming, fishing, animal husbandry, forestry, and mining

Income from property transactions

Bonuses or awards for winning competitions, competitions and opportunities

Q:
Who’s overseas income shall be included in the basic income?
A:
The person must meet both requirements in the following:
1. An individual residence in Taiwan.
2. The annual overseas income of the declarer reached TWD 1 million.

Q:
What is the threshold for Taiwanese individuals’ overseas income to be included in the basic income?
A:
If the reporting household’s annual overseas income reaches TWD 1 million, the full amount should be included in the basic income; if the entire household’s annual overseas income does not reach NT$1 million, its overseas income does not need to be included in the basic income.
