Q:
If an insured person under Taiwan Labor Insurance has participated in the National Pension Insurance, can the years of National Pension Insurance be taken into account when claiming disability benefits? How should the payment amount be calculated?
A:
When the insured person under labor insurance becomes disabled due to injury or illness and meets the disability pension payment regulations, if he has national pension insurance seniority, for each year of seniority that he has paid national pension insurance premiums, he will be paid according to his national pension insurance premium. 1.3% of the monthly insurance amount is calculated and paid. If after combining the disability annuity benefits from Labor Insurance and the disability annuity benefits from National Pension Insurance, if the amount is less than NT$4,000, the amount will be paid at the rate of NT$4,000.

Q:
If an insured person under Taiwan’s labor insurance has eight teeth broken due to a car accident, can he apply for disability benefits?
A:
If the insured person under labor insurance has lost more than 5 teeth due to accidental injury (excluding dentures), after the treatment is terminated, the symptoms become fixed, and the treatment effect cannot be expected after further treatment, and the patient is diagnosed by a hospital or clinic specially appointed by the National Health Insurance When you are permanently disabled, you may apply to the Labor Insurance Bureau for disability benefits through the insured unit.

Q:
The insured female in Taiwan was over 45 years old when she had her uterus removed due to uterine fibroids. Can she claim disability benefits?
A:
If the insured has both ovaries or uterus removed due to injury or illness during the effective period of the insurance, and is diagnosed with disability after April 1, 2022 (inclusive of that date), the provisions of the revised law may apply, and the insured may apply to the insured through the insurance unit. Apply for disability benefits from the Bureau of Labor Insurance. However, if the insured has had a hysterectomy before March 31, 2022 (inclusive) and is over 45 years old when diagnosed with disability, he or she shall not apply for disability benefits because he does not meet the requirements before the amendment.

Q:
Should the insured person in Taiwan surrender the policy when applying for disability benefits?
A: If the insured receives disability benefits that include "lifelong incapacity to work" in the disability status in the standard schedule for disability benefits, or if the insured person is diagnosed as permanently incapacitated by individual professional assessment, he or she may apply for a "disability annuity" If "benefits" are paid, the Bureau of Labor Insurance will directly withdraw the insurance from the date of actual diagnosis of permanent disability.

Q:
If an insured person under Taiwan’s labor insurance surrenders and is diagnosed with an occupational disease and is diagnosed with permanent disability, can he claim benefits from occupational accident insurance?
A: If the insured person of the labor insurance believes that it was caused by work during the period of validity of the insurance and is diagnosed as an occupational disease after surrendering the insurance, and is diagnosed with permanent disability, he or she can claim occupational disease disability benefits. However, the application needs to be made within 5 years from the date of diagnosis of actual permanent disability, and the same disease can only be claimed once.
