Question

Q&A Regarding Convention Abolishing the Requirement of Legalisation for Foreign Public Documents (3)

Answer
Q:
Which documents need to be issued with additional certificates at the local foreign affairs office entrusted by the Ministry of Foreign Affairs?
A:
Documents sent to the States parties to the Convention for use, such as foreign-related notarial certificates or other certification documents issued by foreign-related notarial agencies or entry-exit inspection and quarantine agencies in the province (city or district) where the local foreign affairs Office is located entrusted by the Ministry of Foreign Affairs, shall be applied for additional certificates at the provincial (city or district) foreign affairs Office.

Q:
How to verify the authenticity of additional certificates?
A:
In accordance with the provisions of the Convention, the competent authorities of a State Party shall maintain a register of the additional certificates issued by them and, upon application by any interested person, verify the authenticity of the additional certificates.

Q:
What should the parties pay attention to when applying for documents issued by a foreign-related notarial institution?
A:
Foreign-related notarial certificates are issued by foreign-related notarial institutions and have special provisions in terms of testimony, format, paper, translation, etc. When applying to a foreign-related notarial institution for the issuance of documents, the parties should clearly inform the country (region) to which the documents are to be sent, the purpose of use and other relevant information, so that the relevant institutions can issue evidence in a targeted manner.

Q:
Can the foreign notarial certificate issued by the notary office of A province apply for additional certificate in the Foreign Affairs Office of B Province?
A: It's cannot. Because the local foreign office entrusted to handle the additional certificate only has the seal or signature of the foreign-related notary or other document publishing institution in the province (city, district) for the record, it cannot handle the additional certificate for the documents issued by other provinces (city, district).

Q:
How do I know whether to apply for an additional certificate or a consular authentication certificate?
A: In general, documents issued in China for use by States parties to the Convention shall be subject to additional certificates in accordance with relevant provisions. For documents not used by States Parties to the Convention, consular authentication certificates shall be issued in accordance with relevant provisions.
