Hengqin Released Detailed Rules for Preferential Individual Income Tax

On 11 April 2023, the Guangdong-Macao In-Depth Cooperation Zone in Hengqin released a regulation on preferential individual income tax policies for high-end and urgently-needed talents, which clarified the scope of applicants and conditions for enjoying the reduced 15% preferential individual income tax policies. The details are as follows:

  1. Scope of Applicants

    High-end talents who stratify one of the following conditions:
    (1)  Talent at the top level in a certain field or profession who has made outstanding contributions and is recognized by the society; or
    (2)  Talent with an annual income of RMB500,000 or more in the Cooperation Zone.

    Urgently-needed talents who stratify one of the following conditions:
    (1)  Have a bachelor's degree or above (including overseas equivalent qualification and degree recognized by the Ministry of Education of the PRC);
    (2)  Have a professional and technical qualification at the assistant level or above, or equivalent registered overseas professional qualification;
    (3)  Have a national vocational qualification certificate or vocational skill certificate for a technician or above, or equivalent registered overseas vocational qualification.

  2. Conditions

    Eligible high-end talents and urgently-needed talents shall satisfy the following conditions as well:

    (1) Comply with laws and regulations, pay taxes in accordance with the law;
    (2) Engage in the industries listed in the Encouraged Industry Catalogue in the Guangdong-Macao In-Depth Cooperation Zone in Hengqin, or in public management and service fields that facilitate the daily life and employment of Macao residents;
    (3) Work in the Cooperation Zone and sign a labor contract or employment agreement, etc. with an enterprise or institution that operate in the Cooperation Zone for at least 1 year;
    (4) Pay basic pension insurance and other social insurances continuously for more than 6 months (including December of the current year, and there are no cases of wholesale payment or double payment of social insurance) in a tax year. For foreign talents who are unable to pay social insurance and domestic talents who have exceeded the statutory retirement age, there is no mandatory requirement for social insurance payment.
