Q: What is Resident Representative Office of Foreign Enterprise?
A: The Resident Representative Offices of Foreign Enterprise refers to an office of a foreign enterprise established in China to engage in non-profit activities related to the business of the foreign enterprise in accordance with the Regulations on the Registration and Administration of Resident Representative Offices of Foreign Enterprise. Representative Offices do not have legal personality.

Q:
Under what circumstances does a Representative Office need to be deregistered?
A:
Under one of the following circumstances, the foreign enterprise shall apply to the registration authority for deregistration within 60 days from the occurrence of the following matters:
1.
The foreign enterprise cancels its representative office;
2. The Representative Office will not continue to engage in business activities after the expiration of the residence period;
3. Foreign enterprises terminate operation;
4. The Representative Office is revoked or ordered to close according to law.

Q:
After a Representative Office is revoked, can it be transferred to normal operation status again?
A:
No, you can only apply for deregistration with the registration authority.

Q:
What materials need to be provided for the deregistration of a Representative Office?
A:
1.
Application form for deregistration of Representative Office;
2. Tax clearance and deregistration certificate from tax registration of the Representative Office;
3. Relevant proofing documents issued by the customs and foreign exchange departments for the clearance of the procedures.

Q:
How long does the deregistration of Representative Office take?
A:
The registration authority shall decide on whether to approve the deregistration within 10 days from the date of acceptance of the deregistration application. If the deregistration decision is approved, a notice of deregistration approval shall be issued within 5 days from the date of the decision, and the Registration Certificate and Representative Card shall be collected.
