The New Policy for International Students to Settle in Shanghai

Answer
The Shanghai Ministry of Human Resources and Social Security has released a new version of the International Student Settlement Policy, which has been officially implemented from December 1, 2020 and is valid until November 30, 2025. Compared to the previous regulations, the new policy and what adjustments?

Q: What are the academic requirements for international students?
A:
1. If you have obtained your doctoral degree from a foreign university, the accumulated study time abroad is generally not less than one year; if you are a graduate of a Sino-foreign cooperative education or joint training, the accumulated study time abroad is generally not less than half a year;
2. Full-time undergraduate degree, bachelor's degree or above, obtained in domestic "double first-class" construction universities (the graduate training units directly under the Central Government and the Chinese Academy of Sciences refer to "double first-class" construction universities), and master's degree obtained in overseas universities; or full-time undergraduate degree, bachelor's degree or above, obtained in domestic non-"double first-class" construction universities, and master's degree obtained in overseas high-level universities; or bachelor's degree and master's degree obtained in overseas universities;
3. Bachelor's degree from a high-level university in a foreign country;
4. After obtaining a master's degree or above in China or obtaining the qualification of deputy senior professional and technical positions or above, go to foreign universities or scientific research institutions to further study, do visiting scholars, etc. for one year;
5. Bachelor's degree or master's degree obtained from overseas universities.

Q:
Are there any regulations on the social security payment base for those who meet the educational requirements?
A:
In accordance with the provisions of (1) to (4) above, the base amount of social insurance contributions in the same unit for the last six consecutive months shall not be lower than the average salary of employed persons in urban units of the city in the previous year;
In line with the provisions of item (5) above, the last 12 consecutive months in the same unit social insurance contributions base is not less than 1.5 times the average salary of the city's urban units employed in the previous year.

Q:
Is it possible to apply if social security generates a retroactive payment?
A:
Those who have not paid social insurance premiums normally and make up for it, those who have paid units that are inconsistent with those who have signed contracts, those who have entrusted third parties such as non-actual employers to pay, and those whose social insurance contribution bases do not reasonably correspond to their personal income tax payments will not be recognized.

Q:
Whether the dispatched employees can apply for settlement according to the regulations?
A:
Dispatchers in principle do not belong to the scope of the application.

Q:
Must international students come to work in Shanghai directly after returning to pay social security and personal tax?
A:
In the new version of the policy, this clause is adjusted to the effect that students should come to the city and work in the city continuously within 2 years after returning to China. In other words, if the first workplace is not in Shanghai, you can still apply according to the regulations as long as you join the workforce in Shanghai within 2 years after returning to China.

Q:
Are there any incentive conditions in the policy?
A:
Those who hold positions equivalent to associate professor, associate researcher or above in high-level universities and internationally renowned scientific research institutions abroad, those who hold senior management, technical and scientific research positions in the world's top 500 companies and multinational corporations, or those who are recognized as high-level talents by the Shanghai Human Resources and Social Security Bureau, as well as those who have obtained doctoral degrees from high-level universities abroad, can apply for settlement directly after coming to work in the city on a full-time basis;
The employers included in the "Shanghai Science and Technology Innovation Career List", and those who have obtained a bachelor's degree or above in science, technology, engineering and mathematics from high-level universities in foreign countries can apply for settlement after working full-time in the city and paying social insurance premiums for 6 months;
The person in charge and the core members of the team (generally no more than 3 people in total) who have patents, scientific research achievements, proprietary technologies, etc. and come to the city to set up an enterprise for overseas students can apply for settlement after the enterprise is in normal operation, employs at least 1 employee (excluding the person in charge) and has paid social insurance premiums for 6 months according to the regulations. The registered capital of the enterprise is not less than RMB 500,000 (paid up), and the person in charge of the enterprise is the first major shareholder (excluding share transfer and later capital injection), and the personal shares are generally not less than 30%.

Q:
Are there any adjustments to the materials submitted in the new regulations?
A:
The new version specifies that the materials can be verified through data sharing or online and can be retrieved through the electronic license library, without the need for duplicate submissions.
