Question

Q&A Concerning Extension and Change of Foreigner's Work Visa

Answer
Q:
When I changed my employer company in Beijing, do I need to change my work visa?
A: First, you need to cancel the existing work permit, and then reapply for the foreigner's work permit under the name of the new employer company. When the new work permit is approved, apply for the change of residence permit.

Q:
The name of my employer company has changed, does it affect my work visa?
A:
Yes, it does. The company shall apply for the change of the company name to the relevant authority of the work permit. Generally, the information of the work permit will be updated after the change of the company is completed.
Although the change of residence permit is a matter of visa for foreigners, the company can also apply for the change of company name to the exit and entry administration authority on behalf of foreign employees.

Q:
My work visa has three months to expire. Can I extend it now?
A:
Sure. According to the relevant provisions, the extension application for work permit and residence permit should be submitted 30 days before the expiration of the validity period, and the extension can only be handled 90 days in advance.

Q:
When my work visa is due for renewal, while my passport is expired and re-issued and the passport number has changed, can I apply for it at the same time?
A:
Sure. For work permit, although the extension and passport number change can be handled at the same time, it should be noted that according to the regulations, the time for submitting the application is different. The extension is to apply to the examination and approval authority from 90 days to 30 days before the expiration of the original work permit. The change of passport number is 10 working days from the date of the change to apply to the decision-making authority. In terms of urgency, or within 10 working days after the change of passport number, the application should be submitted to the decision-making body for extension and change at the same time.
For residence permit, it is different. According to the regulations, the change of passport number should apply for transfer of residence permit within 10 days from the date of change. For extension, you need to provide an extension certificate of your work permit. For the extension of your residence permit, you can only apply to the exit and Entry Administration separately.
In some cases, the time limit for applying is required to be based on working days, while others are based on natural days. Therefore, attention should be paid to this issue when submitting applications.

Q:
How long can a work visa be extended?
A:
A work permit can be granted for a maximum of five years, so the extension depends on the duration of the initial application. The validity period of residence permit depends on the validity period of work permit, and the maximum validity period is 5 years.
