The Social Insurance and Housing Provident Fund in Shanghai – Maternity Insurance

After introduction of Shanghai's Pension Insurance and Medical Insurance, today we will refer to Maternity Insurance, one of the five major insurance types.

Q:
What is the definition of Maternity Insurance?
A:
Maternity Insurance is a social insurance system that provides for medical services, maternity allowances, and maternity leave by the country and society when the state passes legislation to stipulate that the state passes legislation to provide temporary medical services to pregnant and childbirth employees.

Q:
Only female employees can enjoy maternity insurance treatment, so are only female employees required to participate in maternity insurance?
A:
All employees who have established labour relations with employers, including male employees, should participate in maternity insurance. The maternity insurance is entirely borne by the company and individuals do not need to do the contribution.

Q:
What conditions can the female employees apply for maternity insurance treatment?
A:
For female employees, whose accumulated contribution of maternity insurance premiums for 12 months or continuous payment of maternity insurance premiums for 9 months during the month of childbirth and miscarriage, the maternity insurance fund shall be paid in full by the maternity insurance fund. At the same time, if the employer of a female employee’s childbirth or miscarriage for the month contributed the childbirth insurance premium for less than 12 months and continuously contributed the childbirth insurance premium for less than 9 months, the childbirth living allowance is divided by 12 by the childbirth insurance fund according to the number of months. The proportion of income is paid, and the remaining part is paid in advance by the employer where the female employee’s childbirth and abortion are located. After declaring the accumulated contribution of maternity insurance premiums for 12 months or continuous contribution of maternity insurance premiums for 9 months, the employer can apply to the social security agency for payment.

Q:
How to calculate the maternity allowance in Shanghai?
A:
Generally speaking, the calculation of maternity allowance can refer to the following formula:

  • Maternity allowance = Average monthly salary of the employer last year ÷ 30 days× days of maternity leave (the number of maternity leave days includes maternity leave and parental leave).

Q:
How to deal with if the salary of the employee before maternity leave is higher than the average monthly salary of the employer last year?
A:
Generally speaking, the calculation of maternity allowance can refer to the following formula:

  • If the average monthly salary in the previous year for the employer was lower than the employee's salary standard before maternity leave, the employer shall make up for the maternity allowance based on the employee's salary standard.

Q: How to apply for maternity allowance in Shanghai?
A:  The maternity allowance application should go to local security bureau and submit below materials:
1.
Original copy of identity card;
2. The "Shanghai Municipality Application for Maternity Insurance Treatment and Family Planning Examination Form" or "Shanghai Municipality for Application of Maternity Insurance Treatment and Family Planning Status Certificate" issued by the first level government;
3. If children born in Shanghai, it needs to bring the original copy of "Fertility Medical Certificate" issued by a medical institution;
4. If children born in other provinces and cities, it needs to bring a discharge summary (or medical record) and a copy of the baby's "Birth Medical Certificate" issued by a qualified medical institution that indicates the maternal fertility status (difficult birth, normal birth or abortion);
5. If children born abroad or in Hong Kong, Macau, and Taiwan, it must bring a copy of the medical records and other materials issued by the local medical institution that indicate the maternity status (difficult delivery, normal delivery, or abortion);
6. Maternity Insurance Benefit Application Form;
7. Copies of the materials shall be signed by the applicant. If it entrust the agent to handle it, it is necessary to carry the letter of authorization signed by the applicant and the original copy of identity card of the agent and copy of front and back of the ID card;
8. If the materials are non-Chinese, the translation in Chinese with the seal of the translation agency shall be provided.
