Q: Can enterprises reduce the wages of female workers on the basis that they are in the third period?
A: According to the Law of the People's Republic of China on the Protection of Women's Rights and Interests, no unit may reduce the wages of female employees due to circumstances such as marriage, pregnancy, maternity leave or breastfeeding.

Q:
If an enterprise transfers a third-term female employee to another lower-ranking position on the grounds that she does not fit into the original job, can she be paid at the lower-ranking salary?
A:
In the implementation of the Law of the People's Republic of China on the Protection of Women's Rights and Interests in Shanghai, it is stipulated that if a female employee does not adapt to her original work position during pregnancy or breastfeeding, she may negotiate with the employer to adjust her work position or improve the corresponding working conditions during that period. The employer shall not reduce her original wage income.

Whether the enterprise can terminate the employment contract when the female employee is in the third period?
A:
Enterprises shall not dismiss female workers due to marriage, pregnancy, maternity leave, breastfeeding, etc., and unilaterally terminate labor (employment) contracts or service agreements. However, except for the termination of labor (employment) contracts or service agreements requested by female workers.

If a female employee is in a three-term situation at the end of the employment contract and the enterprise does not intend to renew the employment contract, what should be done?
A:
The employment contract shall be renewed until the corresponding circumstances disappear and terminate. That is, the female employee's breastfeeding period ends.

Q:
How many days of maternity leave do female workers have in Shanghai?
A:
Female workers in Shanghai are entitled to 98 days of maternity leave, including 15 days of prenatal leave, and 30 days of maternity leave. In case of difficult birth, the maternity leave will be increased by 15 days; in case of multiple births, the maternity leave will be increased by 15 days for each additional baby.
