Frequently Asked Questions of e-Stamping of Document in Hong Kong

Q: What is the difference between e-Stamping of document and conventional stamping?
A: Conventional stamping is a manual process with the imprinting of stamp on original instrument while e-Stamping is made via online mode.

Q:
Do I need to register before using this e-Stamping services?
A:
Not necessarily, but you need a means to authenticate online using:
E-Stamp Account; or
Taxpayer Identification Number and eTAX Password; or
Digital certificate issued by the Hongkong Post or the Digi-Sign Certification Services Ltd.

Q:
What kind of documents can be stamped through e-Stamping?
A:
It applies to the following most common types of documents:
1. Initial stamping of Agreement/Assignment with 1) not more than 4 purchasers 2) not chargeable with Special Stamp Duty (SSD) 3) not chargeable with Buyer's Stamp Duty (BSD) and no application of for:

(1) charging Ad Valorem Stamp Duty at lower rates (Scale 2), except that the application is for the reason that the buyer declares that he/she is a Hong Kong permanent resident and is not beneficial owner of any other residential property in Hong Kong and acting on his/her own behalf on the date of acquisition,
(2) exemption of SSD; and/or
(3) exemption of BSD, except that the application is for the reason that the buyer declares that he/she is a Hong Kong permanent resident acting on his/her own behalf in acquiring the property.
2. Payment of deferred stamp duty
3. Subsequent Agreement/Assignment
4. Tenancy agreement with rent and no premium paid and not more than 4 landlords and 4 tenants
5. Contract Note and/or Instrument of Transfer

Is e-Stamping services compulsory?
A:
It is not compulsory. You can still use the conventional stamping method.
